Terms of Service

1. Acceptance of Terms

By accessing or using forwarding.mobi ("Service"), operated by MappedBy Inc ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service.

2. Description of Service

forwarding.mobi provides phone number forwarding services, allowing users to obtain a dedicated phone number that forwards calls and text messages to their personal phone. The Service includes call analytics, SMS forwarding, and related features.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must be at least 18 years old to use this Service.

4. Acceptable Use

You agree NOT to use the Service for:

• Any illegal activities or to facilitate illegal activities
• Harassment, threats, or abuse of any person
• Spam, unsolicited marketing, or robocalls
• Fraud, impersonation, or deceptive practices
• Violating any applicable laws or regulations
• Interfering with or disrupting the Service

We reserve the right to suspend or terminate accounts that violate these terms without refund.

5. Prepaid Service & Payment Terms

FORWARDING.MOBI IS A PREPAID SERVICE. You must purchase credits in advance to use the Service. Credits are deducted as you use calling, texting, and phone number rental features. New accounts receive $1.00 in complimentary credits.

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. By purchasing credits, you acknowledge and agree that:

• All credit purchases are final and cannot be refunded under any circumstances
• Credits have no cash value and cannot be exchanged for cash
• Credits are non-transferable between accounts
• Unused credits do not expire but are forfeited upon account termination for Terms violations
• You waive any right to dispute or charge back any purchase made on this Service

CHARGEBACK POLICY: If you initiate a chargeback or payment dispute with your bank or credit card company for any purchase made on forwarding.mobi, your account will be immediately suspended and may be permanently terminated. We reserve the right to pursue collection of any amounts owed, including chargeback fees, through appropriate legal channels. Initiating a chargeback constitutes a breach of these Terms.

We reserve the right to modify pricing at any time with reasonable notice. Price changes will not affect credits already purchased. If you do not agree with price changes, you may stop purchasing additional credits and use your remaining balance.

6. Phone Numbers

Phone numbers provided through the Service are licensed, not sold. We reserve the right to reclaim numbers that are inactive for extended periods or used in violation of these terms. Number availability varies by area code and is not guaranteed.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable for maintenance or due to factors beyond our control. We are not liable for any damages resulting from service interruptions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAPPEDBY INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

9. Indemnification

You agree to indemnify and hold harmless MappedBy Inc and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

10. Modifications

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. Material changes will be communicated via email or through the Service.

11. Termination

You may terminate your account at any time through the dashboard settings. We may terminate or suspend your account for violation of these terms, suspicious activity, fraud, or for any other reason with or without notice.

Upon termination: Your right to use the Service ceases immediately. Any remaining credit balance is forfeited and will not be refunded. Your phone number(s) will be released and may be reassigned to other users. Call and message history may be deleted. This applies whether termination is initiated by you or by us.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of competent jurisdiction located in Toronto, Ontario, Canada.
